UCC Department

UCC's are for the purpose of creating a security interest in personal property. This applies to any transaction intended to establish a security interest regardless of its form. UCC's, Chattel Mortgages, Bills of Sale and other instruments affecting title or encumbering personal property are required by law to be recorded. EXCEPT MOTOR VEHICLES WHICH ARE FILED WITH THE OKLAHOMA TAX COMMISSION.

UCC FILINGS BEGINNING JULY 1, 2001

Effective July 1, 2001, the place to file a UCC document to perfect a security interest in all types of collateral is: Oklahoma UCC Central Filing Office.

After July 1, 2001, the other 76 counties will not be filing regular UCC's in your county.

Exceptions

12A O.S. 2000 1-9-501 and 1-9-502 (please read)

If the collateral is as extracted collateral or timber to be cut, or the financing statement is filed as a fixture filing on collateral which goods are or are to become fixtures.

The filing location is in the county in which the real estate is located.

The above filings shall include a real estate description adequate for recordation and indexing in the records of said office where the real estate is located, and would be filed in the same place and manner as a mortgage on real estate is filed.

The filing fee would be the same as the fee charged for any other instruments filed in the real estate records.

Signature or Acknowledgement:

1 2A O.S. 1-9-501 does not require signatures on UCC's, only names. 12A O.S. 1-9-501 2F states that UCC's do not have to comply with the execution and acknowledgment as required in 16 O.S. 26.

The above filings may be continued, terminated, assigned, or released by a separate UCC instrument when it includes the adequate legal description and the proper recording fee is received.

Current UCC Records

( Filed prior to July 1, 2001 )

Each county clerk will keep their existing non- real estate related UCC filing records until they are released or expire.

When a release of a UCC filed prior to July 1, 2001 is received in the county clerk's office, it is released with no charge. The fee for the original filing and the release were received at the time it was filed.

UCC searches will only be done on UCC's that were filed before July 1, 2001. The fee for any search (written or verbal ) will be $10.00.

After July 1, 2001, ALL searches must be done through Central Filing in Oklahoma County.

UCC FORMS

UCC-3 Continuation statement, location change, assignments, amendments, releases or partial releases.

UCC-4 Information and Certification: This form is used for verbal and written searches. This request will include the filing information for a specific party and the name and address of the secured party.

UCC-7 Termination statement. The secured party must file a termination statement to release the original UCC. It must include all the filing information related to the original filing and must be signed and dated.
